Al-Baqarah Verse 282

"O you who believe! When you deal with each other, in transactions involving future obligations in a fixed period of time, reduce them to writing, let a scribe write down faithfully as between the parties; let not the scribe refuse to write; as God has taught him, so let him write. Let him who incurs the liability (debtor) dictate, but let him fear his Lord God, and not diminish aught of what he owes. If the party liable (debtor) is mentally deficient, or weak, or unable himself to dictate, let his guardian dictate faithfully, and get two witnesses, out of your own men, and if they are not two men, then a men and two women, whom you trust, so that if one of them errs, the other can remind him. The witnesses must not refuse when they are called upon to do so. You must not be averse to writing (your contract) for a future period, whether it is a small matter or big. This action is more just for you in the sight of Allah, because it facilitates the establishment of evidence and is the best way to remove all doubts; but if it is a common commercial transaction concluded on the spot among yourselves, there is no blame on you if you do not put it in writing. You should have witnesses when you make commercial transactions. Let no harm be done to the scribe or witnesses; and if you do so, you shall be guilty of transgression. Fear Allah; it is Allah that teaches you and Allah has knowledge of everything."

My lecturer shared the above verse with the class. All this while, I didn't realise the importance of my profession from my religion's point of view.

The witnesses must not refuse when they are called upon to do so. You must not be averse to writting (your contract) for a future period, whether it is a small matter or big. This action is more just for you in the sight of Allah, because it facilitates the establishment of evidence and is the best way to remove all doubts; but if it is a common commercial transaction concluded on the spot among yourselves, there is no blame on you if you do not put it in writing. My hubby change from conventional credit card to islamic credit card (ICC), the bank called to make an 'akad' tapi ida ada terbaca somewhere, berkaitan jualbeli which means mesti ada brg, tapi with ISS, brg tak de, tapi akad hutang telah dibuat, can explain?

aida said...

kak ida, masa aida ambil cc bank islam hari tu.. die suruh akad pakai perjanjian beli barang. in my case, akad macam beli komputer sebijik je.. mmg kena baca akad tu time amik kad kredit. eheheh

Biasanya utk hujjah/dalil d mana2..diambil satu/sebhg/seberapa byk ayat..mengikut konteks keperluan penghujahan..krn setiap satu frasa membawa maksud yg tersendiri/saling berkaitan..
Begitulah yg ambo fhm..
Come2 belako tu..demo2 gi further study..kita2 blh ppakat rujuk..

itulah aini, k.ida pernah dgr ada yg kata gitulah...tapi, ni yg k.ida ingatlah kata2 nik aziz berkaitan bank islam masa tu, dia ckp kalau dihidangkan daging sembelih ngan daging yg kena langgar kat lori, pilihlah daging yang sembelih tu..

Pastu yg part ni paling kak ida ingatlah, katanya, biarlah bank islam tu x berapa betul mana lagi, at least dah ada jalan2 ke arah itu dan insyaalah akan dibetulkanlah mengikut kaedah Islam yg betul..

Thanks...good reminder for us to make a point to regularly look at the verses from the Holy Book and ponder upon the meanings (tadabbur). A step further is to refer to the book of tafseer (eg. Ibnu Katheer, Pimpinan Ar Rahmaan, Fi Zilalul Quran) - some of which are now available free on the internet, eg. ibnu katheer (full) and zilal (part).

This posting also serves as a good reminder for us to broaden our knowledge to have proper understanding of the Holy Book & the Sunnah....with guidance from the many publications produced by renowned scholars (ulama' muktabar), as understanding of those two main sources will be incomplete without having the understanding of the "sciences" involved, such as the science of the hadis (ulumul hadis), tafseer (Arabic as a language, nasikh-mansukh, asbabun nuzul etc.), syariah and the purpose of shariah etc.

There are many good book for "dummies" like us to start with for all these...and it doesn't take that much (time and penny wise) to spend on. The investment is well worth it: here and in the hereafter.

For men (and women) of understanding, we should not leave the understanding of this very important part of faith to the "ustaz" alone - we should learn from them yes, but at the same time we should also strive to continously enrich ourselves with the vast knowledge and sources available.
